New Planning Laws Extend Permission Periods for 5 Years |

The Planning and Development Bill (Amendment) was passed in the Dáil on the 1st of July, 2010 and came into effect in August. Senator Daly worked hard to have the amendment which provides for the extension of lapsed planning permission included.
The legislation allows applicants to apply for existing planning permissions to be extended for up to 5 years if the relevant planning authority is “satisfied that there were considerations of a commercial, economic or technical nature beyond the control of the applicant which substantially mitigated against either the commencement of the development or the carrying out of substantial works pursuant to the planning permission.” Planning authorities “shall give notice of a decision on an application under this section within the period of 8 weeks”.
